建设性后现代主义视域中的法治思维

Legal Thinking from the Perspective of the Constructive Postmodernism

法治思维是一个变化生成中的观念,具有开放的结构,任何定义都难以描述其全部内涵,但它毕竟具有一般的、普遍的意义。对法律的信仰、对权力的限制、对权利的保护、对生存的规范、对生态的呵护等应当是法治思维的核心内涵;形式程序思维、彰显实质正义、更新具体秩序等应当是法治思维养成的途径。在建设性后现代主义视域中,法治思维随着传统的不同而有所变化、发展,因此,中国必然拥有中国式的法治思维,不能以西方法治思维的模式作为其标准。

Legal thinking is a generating idea with an open structure. Although any definition is difficult to describe its entire connotation, it has a general, universal significance. The belief in law, the limits to the power, the protection of rights, the standard for existence, and the protection for the ecological system should be the e, ore connotation of the legal thinking. Moreover, the formal program thinking, highlighting the substantial justice, updating the order should be ways to develop legal thinking. From the perspective of the constructive postmodernism, legal thinking varies and develops with the changes of traditions, therefore, China must have the China-style legal thinking, and shouldn＇ t take the western mode as the standard.
