摄影作品的独创性表现为摄影器材的选取、摄影参数的调整、摄影时机的选择和摄影者个性化的安排。制式的证件照片不构成摄影作品;体现拍摄时机的抓拍照片可以构成摄影作品;机器自动拍摄的照片一般不构成摄影作品,但体现了人工干预、人工选择的照片可以构成摄影作品。
