中外侨民海外投资风险防范机制之比较

Comparison and Introduce: On Chinese Overseas Investment Risks and its Prevention

保护侨民问题已经成为一个世界性的难题,能够有效保护侨民是大国地位的象征。随着中国海外投资活动的剧增,中国侨民海外所面临的风险在加剧,主要表现在:投资效益差、安全无保障、权益受侵害、投资环境差、政治不稳定等方面,这与侨民自身发展模式缺陷、风险意识不强、侨民保护法律法规不完善等密切相关。我国政府机构(侨务和出入境管理等部门)应借鉴西方的成功经验,立足本国国情,搭建便利侨民出入境服务平台,形成侨民跨地区网络联动机制,强化事前积极预防、事中及时干涉、事后妥善处理意识,必要时可动用领事保护,出台《侨民保护法》、《领事保护法》等措施以有效规避我国侨民海外投资风险。

Along with the surge in China＇s overseas investment activities, Chinese overseas investment of financial and non-financial risks are intensifying, which is closely related to the defects of overseas Chinese development pattern, lack of risk awareness, imperfection of the law of overseas Chinese protection, etc. Our country should draw lessons from the successful experience of western countries, build convenient nationals entry and exit service platform, form a cross-regional network linkage mechanism, strengthen the consciousness of the positive prevention in advance, timely intervention in process and properly handle the issues afterwards, and draw upon the consular protection when necessary, introduce some measures such as the Overseas Chinese Protection Act as well as Consular Protection Act, to effectively avoid Chinese nationals overseas investment risk.
