“土地换保障”权益协调机制建设——基于“公域”“私域”与“第三域”的法社会学探索

On Coordination Mechanisms of Rights and Interests for “Exchanging Land for Social Security”: From Perspectives of Public Space,Private Space and the Third Space in Sociology of Law

城镇化进程中"土地换保障"作为一种权益协调机制得以产生,但其自身却存在诸多制度缺陷和权益冲突。作者借助"域"和"法"的三分法对"土地换保障"权益协调机制建设进行了探索,研究发现任何强制性的"土地换保障"都是不合法和不合理的,相关权益协调机制建设应明确"公域""私域"与"第三域"的利益边界和行动规则,从价值补偿、争议协调和路径优化三方面入手推进城乡统筹发展。

＂Exchanging Land for Social Security＂ grows as a coordinating mechanism of rights and interests in urbanization, but there are many flaws and conflicts in its own systems. From the prospective of ＂Space＂, the article points out that interest coordination mechanisms and should emphasize value compensation, dispute coordination and path optimization, should clarify the interests boundaries and action rules of these spaces; any mandatory ＂land for security＂ is illegal and unreasonable. The path optimization of ＂land for security＂ is discussed in order to propel urban-rural harmonious development.
