地方人大常委会立法的体制与机制问题研究

Research on Legislative System and Mechanism of the Standing Committee of Local People's Congress

地方人大常委会立法的体制与机制是关于地方人大常委会的立法权限、立法权载体、立法权运行等方面的体系、制度和规则。目前,地方人大常委会立法的体制与机制问题,主要表现在立法权事项划分不清晰、多元主体参与的保障机制不完善、立法权运行的程序设计不合理等方面。要从明确地方人大常委会的立法权限,建立健全多元主体参与的保障机制,进一步优化立法程序等方面完善地方人大常委会立法的体制与机制。

Legislative system and mechanism of the Standing Committee of Local People＇s Congress include systems and rules concerning the legislative authority, the legislative subjects, the legislative process and so on. At present, problems of legislative system and mechanism of the Standing Committee of Local People＇s Congress lie in three aspects： the fuzzy boundary of the legislative authority, the faulty safeguard mechanism of the participation of multiple subjects and the unreasonable procedure of the legislative process. In order to solve them, some effective measures, which include precisely defining the legislative authority, establishing and improving the safeguard mechanism of the participation of multiple subjects and bettering the procedure of the legislative process, should be put into force.
