摘要
改革开放以来民间金融的蓬勃发展与民间金融服务机构监管立法的严重滞后,必将促使民间金融服务机构监管作为一种制度安排受到政府的重视。然而从实践上看,我国民间金融服务机构的监管立法现状不容乐观,并严重影响了其自身发展,也制约了其活跃民间金融市场作用的发挥。在总结域外民间金融服务机构监管立法的基础上,立足本国实际情况,提出我国应在明确监管主体、监管方式和监管权限的基础上,对民间金融服务机构的设立登记进行科学布局,实行政府监管和行业自律双重监管模式,确立以担保制度为核心的法律责任追偿机制。
