互联网经营者相关商品市场界定方法的反思与重构 被引量:12

摘要 相关商品市场的界定是反垄断法的核心问题,也是反垄断执法的首要任务。在互联网市场中,"免费"模式、商品的网络效应以及平台化经营模式等,成为影响互联网经营者相关商品市场界定的基本要素,其直接影响互联网经营者相关商品市场的界定方法:对具有网络效应的商品适用需求替代分析法时需充分考虑网络效应对消费者需求的影响;在平台化经营模式下,为了避免相关商品市场的扩大化不宜适用供给替代分析法;由于"免费"模式和网络效应的影响,假定垄断者测试法也需要比对价格的增加幅度以及消费者对互联网商品的依赖作出变通和调整。 The delineating the relevant product market is one of the core issues of anti - mo- nopoly law, also as the primary task of the anti - monopoly law enforcement. The special nature of the internet market include the "free" model of product management, network effect and the business model of the platform which have became the basic elements of delineating the relevant product market of internet operators and also directly affect the methods of delineating the relevant product market of internet operators: When the products with network effects, the impact of net- work effects on consumer demand should be fully considered in the application of demand substi- tution; In order to avoid the expansion of relevant product market, the supply substitution is not applicable under the business model of the platform; The hypothetical monopolist test should make modifications and adjustments according to the magnitude of the price increases and the consumers' dependency on the internet products by the influence of the "free" model of product management and network effect.
