公共管理视角下派驻乡镇检察室分析——以海南派驻乡镇检察室为例

为推进司法改革及填补农村检察工作的盲点,海南省人民检察院结合海南实际,在乡镇派驻乡镇检察室。以公共管理相关理论为支撑分析这一创新实践是一个重要的理论视角转换,基层检察院设置派驻乡镇检察室切合公共管理的内在需求,具有合理性;符合我国公共组织设置的规则和精神,具有合法性;顺应我国乡村治理模式的发展趋势,具有必要性。这种探索在实践层面具有一定的示范和引领作用。基于公共管理相关理论,有必要从法律规制、派驻乡镇检察室的区域布局、协调与其他基层公共组织的关系和加强法律监督等方面推进派驻乡镇检察室工作。

In order to promote the judicial reform to fill the blind spot existing in the rural procuratorial work, Hainan Provincial People＇s Procuratorate carries out the practice of setting up township attorney office based on the real situation in Hainan. Analyzing this innovative practice of Hainan province from the theories related to public management is an important theoretical and perspective transition. The grass -roots procuratorates＇ setting up township attorney office is rea- sonable, legal, and necessary, as it respectively meets the inner needs of public management, conforms to the rules and spirit of setting up public organizations, and follows the development trend of the rural governance model in China. In addition, it has some exemplary and leading role at the practical level. According to the theories of public administration, it is necessary to pro- mote the work of setting up township attorney offices from such aspects as the laws, rules and regulations, the regional layout of township attorney offices, the coordination with other local public organizations, and the strengthening of legal supervision, etc.
