Research on Protection and Management of Geographical Indication of Indonesia

中国与印尼地理标志保护合作有重要的经济和政治意义。研究印尼地理标志保护的法律依据、保护的产品种类、管理机关、地理标志注册程序,认为在Trips协议下,中国与印尼在地理标志保护的对象主要以农产品、食品、工艺品为主,互认互保合作有一定的产品基础,但首先要解决商标法模式与专门法模式的衔接问题。

The cooperation between China and Indonesia in protection and management of geographical indication is of economic and political significance. The research on protection and management of geographical indication of Indonesia in terms of legal basis, protected item categories, supervising agencies and geographical indication registration procedure suggests that, under TRIPS agreement, protection of geographical indication in China and Indonesia should aim at agricultural products,foods, arts and crafts. Priority should be given to the connection between trademark law models and special law models before mutual recognition and protection,which has certain product basis.
