国际刑法视野下的人体器官买卖罪行研究

The Crime of Human Organs Trading Under the Vision of International Criminal Law

随着当前国际经济形式的变化,人体器官买卖已逐渐演变成一种严重损害国际利益的国际罪行。不仅大部分国家在其国内刑法中对其加以规制,国际上亦在进行多样的密切合作和相关立法活动。虽然目前为止国际上仍没有一部规制人体器官买卖罪行的国际条约,但一些国家和组织都在进行着各种努力,并且形成了一些具有指导意义的宣言和决议。在人体器官买卖罪行的具体构建上,应该明确其具体行为类型、主体以及具体的管辖问题。

With the current changes of the international economy, human organ trading has gradually evolved into a serious international crime. Not only most countries regulate it in their domestic criminal law, but also international organizations perform a variety of close cooperation and draw up the law. Although there is still not a specialized international treaty to regulate the crime of human organ trading in the international community. Some countries and organizations are conducting a variety of efforts, and formed a number of declarations and resolutions which have guiding significance. To build the crime of human organ trading ,we should be clarify the type of behavior, the issues and the jurisdiction of the crime.
