目前国内保险学家和法学家对保险欺骗与保险欺诈二者的界定并不明确。保险欺骗特指保险人，包括保险公司及其工作人员、保险代理人或保险经纪人，以其职务进行欺骗活动。对保险欺骗的特点、表现形式、构成要件、产生原因等问题进行研究，可为今后完善相关的法律法规提供一些理论依据。

At present the domestic insurancist and jurist haven't distinguished the insurance deceive from the insurance jugglery. The insurance deceive refers to the action which is done by the insurer, including the insurance company, the insurance agent or the insurance broker, by means of occupation. If we study the problems about the characteristics, formation, components and reasons for producing about the insurance deceive, we will get some theoretical basis for setting up perfect laws and regulation bout insurance in the future.
