论我国民事诉讼中的举证责任分配

A Case Study on the Allocation of the Burden of Proof in Civil Litigation of China

举证责任的分配问题在实践中却是复杂而又混乱的,我国民事诉讼法中仅规定了"谁主张,谁举证"的规则,因此造成了对于很多案件法官并不知道如何分配举证责任的情形出现。针对这种现象,应该通过案例来分析我国现状以及目前存在的问题,从立法上、司法解释上以及一些体制上进行举证责任分配的完善。

The allocation of burden of proof in practice is complex and chaotic, as our civil procedure law only stipulates the rule of ＂who advocates, who proof＂, resulting in the case that we do not know how to judge the situation of distribution of burden of proof in many cases. Aimed at this phenomenon, to cite a case to analysis the present situation of our country and the existing problems, and put forward some suggestion of legislation, judicial interpretation and system to improve the allocation of the burden of proof according to the case.
