当今的立法学研究,由于不能清楚认识立法者的身份,不能清楚认识立法学研究所针对的对象,致使这种研究缺乏对实践的指导意义。立法学研究的这种状况,多半是由立法学从法理学中分离和独立出来造成的。此种分离颇似自分析实证法学创立以来法理学从传统哲学和政治学中的分离和独立。借助启蒙哲学和政治学的视野,尤其是借助古典哲学和古典政治学的眷注,我们才能确定立法者的身份以及立法学的对象,当今的立法学研究方能增长见识、提升品质。

Today＇s legislative studies cannot clearly recognize the identity of the legislators or the legislative research object, which leads to the fact that this kind of study has almost done nothing theoretically and done little help practically. The situation is mostly caused by the separation of legislation from the jurisprudence, and this separation is like the separation of jurisprudence from the traditional philosophy and politics after the analytical positivist jurisprudence was originated. With the view of enlightenment philosophy and politics, especially by means of the classical philosophy and the classical politics, we can determine the identity of the legislators and legislation research objects. So, today＇ s legislative studies can increase one＇ s own knowledge and improves one＇ s quality as well.
