集体管理与精神损害赔偿——修订著作权法应重视的两个问题

计算机网络技术和多媒体技术的发展,使作品的使用方式发生了巨大变化,为著作权的集体管理提出了更高、更迫切的要求,著作权的集体管理是我国著作权立法上的弱点之一,应当通过修订法律加以解决。精神损害赔偿在我国著作权法中根本没有规定,借鉴国外的立法和司法实践,建议在著作权法中增加精神损害赔偿的条款。

The using methods of the works have got a great change with the development of the computer network and the multimedia technology. This occasion gives a higher and urgenter demand to the collective management of the copyright, which is a weak aspect of the copyright law of PRC. The compensation for the mental infringement isn't stipulated in the copyright law of PRC. And thus we propose that it's necessary and available for us to draw on the experiences of other countries in the relevant aspects to add some provisions of the compensation for the mental infringement in our law.
