摘要
新一轮农村土地改革包括促进土地承包经营权流转和农村建设用地市场化两项内容,但建设用地制度改革显然是结束城乡二元发展模式、实现城乡一体化发展的关键,是整个农村土地制度改革的核心。农村建设用地制度改革的基本内容和目标是同地同权,即:使农村建设用地去身份、市场化,最终使农村建设用地与城市建设用地具有相同的性质和流通能力,实现城乡建设用地市场并轨。要实现这一目标,必须赋予农民集体土地开发权,引导农村走自主城市化的道路。
The second rural land system reform includes the transfer of contractual right of rural land and marketization of rural construction land. Obviously, the latter is the key to realize the development of urban and rural integration and the core of second rural land system reform. The basic content of rural construction land system reform is that urban land and rural land should be treated equally. Rural construction land should be liberated from rural status and be marketized in order to make rural and urban construction land be integrated into the same market with the same legal nature and capacity. To achieve this goal,we should grant the commercial exploitation right of collective land to farmers and guide them to develop and urbanize independently.
