行政协商视角下我国行政复议制度的改革图景

The Reforming Picture of Our Administrative Reconsideration System in Administrative Consultation Perspective

加强行政复议过程中当事人间的论辩与对话,弘扬主体间的交往理性,既是增进行政复议之纠纷化解能力之必须,也是强化其公正性与实效性的重要选择。因此,将行政协商这种注重行政过程中当事人的主体间性,追求谅解与共识的行政方式融入我国行政复议制度中,对其改革与发展极具理论与现实意义。当前尤为必要回应行政协商的内在要求,推进行政协商机制融入行政复议制度改革过程中,促进我国行政复议组织相对独立化、专业化发展,以及我国行政复议程序之主体博弈回应性、解纷方式灵活性之增强。

In the process of administrative reconsideration,strengthening the debate and dialogue between the parties,and promoting their intersubjective communicative rationality,are both to enhance the fairness and effectiveness of the administrative reconsideration,and to enhance the ability to resolve disputes. Therefore,inserting the administrative deliberation which focuses on the administrative intersubjectivity,and pursuing the understanding and consensus into our administrative reconsideration system,will have great theoretical and practical significance in the reform and development of administrative reconsideration. Now,it is necessary to promote the specialized administrative reconsideration organization which focus on dialogue and negotiation between the parties to reform and develop. Meanwhile,it is necessary to make explicit the quasi-judicial of the procedure of the administrative reconsideration,strengthen the game of intersubjectivity of the procedure of the administrative reconsideration,and proote the flexible and diversity of the way of the administrative reconsideration.
