大数据正在改变我们的生活与思维方式。大数据的基本方法是数据挖掘,而其核心价值在于预测。在大数据时代催生了新的电子证据的采集方法,大数据挖掘技术也给电子证据的发现提供了新思路。在大数据时代最需要做的不仅是努力使电子证据收集模式借助于大数据处理技术发挥更大作用,更应当关注大数据核心价值对电子证据的冲击,应适时地完善电子证据收集的权利与义务,建构当事人公平地接近证据的制度。

Big data is changing our way of living and thinking .Data mining is the basic method of big data ,and its core value consists in its prediction .Data mining technology provides a new idea for large electronic evidence discovery .In the era of big data ,it is thus necessary for us not only to make the collection mode of evidence play a greater role by using big data processing technology but also to confront the effects of big data .We should improve the rights and obligations of collecting e-evidence ;give corresponding weight to the collection of e-evidence by using new technologies ,w hich can effectively protect the parties equitably access to evidence .
