我国投资者保护立法问题研究

Study on the Problem of China's Legislation on Investor Protection

健全的投资者保护制度是促进证券市场持续健康发展之基。我国立法与司法实践逐步彰显出对投资者保护的重视。就立法而言,我国基本建立了投资者保护立法体系。然而,我国投资者保护立法存在许多不足,主要体现为体系不健全、具体规则领域缺陷、民事赔偿制度与救济制度不完善等。针对不足,我国可以通过完善投资者内外部具体制度来健全投资者保护的法律制度。

A sound system of investor protection is the foundation of promoting the sustainable development of the security market.China pays more and more attention to investor protection in legislative and judicial practice.In terms of legislation,China has built up a legislative system of investor protection.However,the legislation in China has lots of shortcomings,for example the system of investor protection is not sound,there are defects in specific field of regulations,the civil compensation system and the relief system are not perfect,etc.In allusion to the shortcomings,China could develop the legal system of investor protection by regulating and perfecting internal and external system.
