摘要
"其他有价证券"指国家发行的国家建设债券、财政债券、特种国债和保值公债等有价证券。彩票不能作为有价证券诈骗罪的行为对象。将伪造、变造的国库券或国家发行的其他有价证券设立抵押、质押不属于本罪中的"使用",此种行为不应当构成有价证券诈骗罪。有价证券诈骗罪与票据诈骗罪、诱骗投资者买卖证券罪等罪应加以区别。
＆quot;Other Securities＆quot; refers to the state construction bonds, financial bonds, special treasury bonds and inflation-proof bonds. Lottery can not be regarded as the object of securities fraud. Using the fake and altered government bonds or other securities issued by state for the mortgage and the pledge is not as same as the “using” in this crime, so it can’t be a securities fraud. The securities fraud is different with the bill fraud and the luring-investor-to-buy-and-sell-securities.
