摘要
海涂围垦的生态补偿类似于邻避冲突的环境风险补偿。补偿机制的框架是"补偿关系主体三元"、"补偿方式三层"的综合。具体内容构建应将权力集中配置给环境保护部门,责任明确督促环保部门积极正确作为,权利分享提供环保集体行动的制度依据。机制的运行需要和环境影响评价衔接,也要和海域使用金制度结合。
The Ecological Compensation Mechanism of Tideland Reclamation is a kind of environmental risk compensation of adjacent to avoid conflict. The compensation mechanism is the comprehensive framework of“ternary subjects for compensation relations”, “triplex layers for compensation mode”. Specific content to build should be concentrating power allocation to the environmental protection departments, clearing responsibility to supervise the environmental protection department to act actively and correctly, sharing rights to highlight the public nature and form the environmental social force. The operation of mechanism needs to link up the environmental impact assessment and combine with the payment system of sea area use.
