摘要
白族习惯法是独立于国家制定的法律之外,在白族人民生产生活中形成的、调整白族社会生活各方面社会关系的、具有强制性和约束力的行为规范的总和。白族习惯法是白族法律文化的重要组成部分,也是白族法律文化的主要载体和表现形式。白族习惯法往往以不成文的方式存在,它的内容涉及各种社会关系的各个层次和生产生活,如民事、刑事、宗教、环境保护、司法等内容。因此,白族习惯法具有多元性、民族性、开放性、地域性、历史性的特点。
The customary law of the Bai nationality is the sum of norms of behavior of the Bai people, which is formed in the people＇s production and life and is to adjust the social relations in all aspects of their social life. It is independent of the state laws, and is mandatory and binding. It is an important part of the legal culture of the Bai people as well as its main carrier and manifestation. The customary law often exists in an unwritten form, and covers all levels and kinds of social relations, such as civil aspect, criminal aspect, religion, environmental protection and justice. Therefore, it has the characteristics of diversity, nationality, openness, regionality and historicity.
