被征地农民安置制度探析

Studies on Resettlement Institutions of Land-Expropriated Peasants

研究目的:重构被征地农民安置的基本理论和制度要素,以期能促进征地安置的进一步改革,保障被征地农民的长久生计。研究方法:归纳法,演绎法。研究结果:重新界定了被征地农民安置的目的、本质、功能、主体、范围、原则、方式、标准和纠纷调处。研究结论:加快制定土地征收法,对补偿和安置制度进行更为详尽的规范;由民政部门牵头,建立征地安置联动机制;构建以"社保+就业"为主体的、充分考虑农民选择权和参与权的多元化组合安置体系;对征地补偿纠纷和征地安置纠纷进行区别化调处。

The purpose of this study was to re-build the basic theory and institutional factors of the resettlement institutions for land-expropriated peasants to promote the reformation and ensure the peasants＇ sustainable livelihood. Methods employed include deduction and induction. The results re-define the purpose, nature, function, subjective, range, principle, model, standard and the dispute mediation of resettlement institutions. The paper concluded that, firstly, the legislation of land expropriation law should be promoted, in which compensation and resettlement institutions should be specified; secondly, a linkage mechanism leaded by ministry of civil affairs should be constructed quickly; thirdly, a diversified combinative resettlement model, basing on social insurance and obtain employment, should be designed, which allow peasants to choose and participate; lastly, differential dispute mediation should be constructed to resolve the disputes of compensation and resettlement.
