论中国卫星导航立法的基本定位

China's Satellite Navigation System and Its Legislation

北斗卫星导航立法的必要性和重要意义已不言而喻,目前所需关注的,是制定什么样的法,即立法定位的问题。就此,又有两个相辅相成的问题亟待厘清:一是立法体例的选择,据以可明了立法目标和模式;二是立法重点的确定,据以可洞悉该领域的重点法律需求。就北斗卫星导航立法体例而言,一方面,应当是由调整该领域各种社会关系的多种不同内容、属性的法律规范所共同构成的综合性法律制度体系而非某个孤立的单一法规;但另一方面,借鉴国外立法实践并结合中国现状,体系性的专门立法并不必要,而应强调针对性和实用性原则,采用单行立法方式来应对其具体的个性问题。就北斗卫星导航立法重点而言,由北斗卫星导航系统的建设目标、客观进程及由此所带来的特殊法律需求所决定,我国目前的当务之急,是制定一部针对卫星导航系统应用的产业促进法。

It goes without saying that the legislation for China's Satellite Navigation System( CSNS)is of both great importance and necessity,and what is worth our consideration is the framing of the legislation. In this regard,two interrelated issues are calling for clarifying: the choice of legislative style which makes clear the legislative objectives and types,and the focal points of the legislation which reflect the main demand of laws in this area. Take the legislative style for CSNS for example. On the one hand,what should be done,instead of producing a single comprehensive law,is to sort out the present legal system of various rules and regulations corresponding to various social relations in this area. But,on the other hand,with the experience of other countries for reference and our legal system for consideration,it can be safe to say that a special legislation system is not of big necessity. Based on the principles of pertinence and practicability,the proper legislative style is to solve the specific issues in a specific area by making specific laws. The focal points of legislation for CSNS can be determined by such factors as the goal for CSNS construction,the present development of it and its demand for legal guarantee. In a nutshell,the most urgent to do is to have an industry law to develop the satellite navigation system in China.
