应急管理与财产权保护的关系是应急权力的限制与财产权的保护之间关系的利益平衡。本文介绍了大陆法系和英美法系中对应急管理与财产权保护的典型立法例,并作出了应急管理与财产权保护的法律基础分析。应急管理与财产权保护机制不仅应在实体法上进行规定,而且应当有完善的程序法规定。在此基础上,本文将应急管理与财产权保护类型化为事前预防机制、事中保护机制和事后救助机制。
