中原农村彩礼现状调查及法律思考——以河南省X县为例

Investigation and Legal Reflection:——the Countryside Bride Price in Central Plains

在我国中原地区农村婚姻与彩礼密不可分,农村民众基本认可女方收受男方适当数额的彩礼。目前,农村彩礼的数额越来越大,彩礼的支付形式主要有现金与实物两种形式,但开始多样化;彩礼影响婚姻的成败和婚后生活;彩礼纠纷主要采取协商的方式解决;借婚骗彩现象严重。而彩礼作为一种婚姻文化,法律应正视并适当规制:完善现行婚姻法司法解释中有关"彩礼返还"的规定;对高额彩礼进行法律规制,同时加大对借婚骗彩行为的刑法打击力度。

In China＇s Central Plains,it is commonly recognized that an appropriate amount of the bride price is acceptable. Currently the amount of rural bride-price is increasing and the payment is in cash and in kind. The bride-price affects the marriage and the married life; the disputes arising from the bride price are mainly solved through negociation; there are more bride price frauds. The thesis,on the basis of the above mentioned facts,proposed that as a marriage culture,bride-price should be appropriately regulated by the laws,provisions of the＂bride-price return＂in judicial interpretation of the existing marriage law be improved and the bride price fraud be fought severely in the name of the criminal law.
