摘要
根据文物仿制品发挥作用的不同,可以将文物仿制品分为"准文物"、"文物艺术品"和"消极文物仿制品"。从目前我国的实践情况来看,文物仿制品是否应予著作权难以从主观的"独创性"理论角度得出令人满意的答案。本文拟从知识产权的"公共领域——私人领域——公共领域"发展模式以及个人利益与公共利益平衡的角度出发,并结合社会文化需求扩张的现实,提出对需要保护的文物仿制品在各方利益平衡的基础上给予著作权保护的建议。
The cultural relics imitations can be classified into three categories according to the roles they play: “quasi cultural relics”, “cultural works of art” and “negative cultural relics imitations”. From the current practice in China. it is difficult to give a satisfactory answer whether or not copyright should be granted to cultural relies imitations. From the point of view of subjective “originality” theory. Starting from the development mode of intellectual property right: public sector-private sector-new public sector, and the balance between public and private interests, and taking into account the expanding social demand of relics, the paper suggests that on the basis of balancing the interests of all parts, copyright be granted to those cultural relies imitations that call for protection.
