组织出卖人体器官罪之探析

The Discussion of Crime of Organizing to Sell Human Organs

我国每年有大量的患者在等待器官移植来挽救自己的生命,可是,在我国器官供与求的矛盾使得器官买卖时有发生、器官黑市横行。我国刑法在《刑法修正案(八)》第三十七条新增设了组织出卖人体器官罪。这里仅对组织出卖人体器官罪中的器官(犯罪对象)、被害人承诺以及违背本人生前意愿摘取其尸体器官这三点来做探析。

Every year a lot of patients are waiting for organs transplant to cure themselves,however,the contradiction of supply and demand makes the trade of the organs happened.At the same time,organs black markets are prevailing.Amendment（VIII） to the Criminal Law of the People＇s Republic of China＇s Article 37 set up the crime of organizing to sell human organs.This article only discusses three points of the crime of organizing to sell human organs,including the human organs（crime object）,the victim＇s commitment and against willingness of the dead to remove his body＇s organs.
