摘要
P2P是我国互联网金融的重要形式之一,近几年在国内呈现出如火如荼的发展之势,它一方面为散户投资提供了可行渠道,为个人和小微企业融资提供了便利途径,另一方面也暴露出越来越多的潜在风险,其逐渐危及行业发展和市场稳定。笔者首先介绍P2P的发展概况,指出问题研究的必要性;其次通过分析国内P2P的具体法律关系和本土特征,揭示其在信用上、操作上、流动性和法律方面的各项风险;最后对比美国监管模式,认为我国P2P更适合作为中介平台纳入监管,应在监管主体、市场准入、持续经营、资金管理和市场退出方面加以规范,并辅之征信体系建设和行业自律的强化。
As an important form of the internet finance,P2P is different from the crowd funding,third party payment platform,direct financing of securities issuance and indirect financing of traditional banks.On the one hand,the P2P model provides investment channels for the lenders and ways of financing for the borrowers.On the other hand,it is still in its infancy,along with potential risks from credit,operation,fluidity and standard rules.To establish a mature P2P market and achieve long-term development,we need to strengthen internal and external governance including a legal system,selfdiscipline and credit inquiry.
