摘要
《劳动争议调解仲裁法》的颁布实施,推动了我国劳动争议仲裁制度的完善,但也暴露了一些尚未解决的问题。其中,劳动争议三方协调机制运行不畅,劳动争议仲裁受理范围较为狭窄,仲裁员水平总体较差,仲裁庭在先予执行中的自由裁量权过大,一裁终局制度不够细化等方面是我国当前劳动争议仲裁制度存在的典型问题。因此,改进劳动关系三方面协调机制,放宽劳动争议受理范围,提高仲裁员任职资格,强化先予执行制度对劳动者的保护,细化一裁终局制度,是进一步完善我国当前劳动争议仲裁制度需要瞄准的方向。
The enactment and implementation of Mediation and Arbitration of Labor Dispute Law helps perfect China's labor dispute ar- bitration system. However, some unsolved problems have remained, which include the poor performance of the tripartite coordination mechanism, the limited scope of labor dispute arbitration, the poor qualifications of arbitrators, the too flexible discretionary right of the arbitration court during the advanced execution, and the non - specification of the single ruling system. Thus, the solutions to the above - mentioned problems will help improve the existing system of the labor dispute arbitration in China.
