摘要
"内部管理信息不公开"逐渐成为政府信息例外不公开的"第三条款"。但是内部管理是否属于政府信息,在实践中却存在较大争议。许多法院把"履行职责"作为政府信息的限定条件,进而将日常工作中的内部管理信息排除在政府信息范围之外,与理论上和实践中人们对于内部管理信息的通常理解相悖。故本文欲通过探索上述分歧的成因,从法律解释的角度,对内部管理信息属于政府信息这一结论进行证成。
The closure of the internal management information gradually become the third terms of gov- ernment information' s closure in exceptions. But there exist many disputed issues that the internal management information belongs to the government information or not. Many courts regard "duty" as the qualification of the government information. So, the internal management information which is informed in daily work is excluded from the scope of the government information. This kind of understanding is not meet to people' usually understanding of the internal management information. This ar- ticle tries to explore the causes of these debates and the proof that the internal management information belongs to government information from the prospect of legal explanation.
