浅析我国价格听证制度的规范化

Standardization of Price Hearing System in China

我国当前价格听证制度存在的问题有:统一听证立法的缺失、听证代表选拔程序不健全、政府部门对听证程序的过度操控以及听证程序本身存在缺陷四个方面,因此,构建规范的价格听证法律制度已成为解决当前现实问题的必然要求。推进我国价格听证制度规范化发展的基本思路:通过统一的听证立法确立听证制度的法律框架;从听证代表遴选、听证主持人选派、听证笔录的法律效力、听证程序违法的法律责任追究等四个方面构建具体的听证制度。

The existing four problems in China＇s current price hearing system are the lack of a unified hearing legislation,the imperfect procedure of selecting the hearing delegates,the government excessive manipulation of the hearing procedure,and hearing defect.And therefore the construction of standard price hearing system has become necessary and inevitable.The paper analyzes basic trains of promoting standardization of China＇s price hearing system,one is through a unified legislation to establish the legal framew ork of the hearing system,the other is constructing the hearing system from selecting the hearing delegates,selecting the presiding hearer,the legal effect of the hearing transcripts,the legal liability of the illegal hearing procedure.
