论唐中后期的宦官参预司法

On the Eunuches’ Intervention in the Judicial Proceedings in the Midst of the Late days of the Tang Dynasty

唐中后期宦官参预司法是唐代中后期宦官专权在司法领域的具体表现 ,虽然在不同时期宦官用不同的名称和形式进行参预 ,但与唐代中后期宦官势力的消长是相辅相成的。宦官超越其职掌而参预司法 ,不仅打乱了原有的中央司法系统 ,侵夺了大理寺、御史台、刑部的司法权 ,还直接破坏了唐中后期的法律制度 。

The Eunuches’ intervention in the judicial proceedings in the middle and late days of the Tang Dynasty was a concrete expression of the monopolization of power on the part of the eunuches. Although the eunuches intervened in judiccial affairs in different names and forms in different periods of time, the degrees of their interventions agreed with the rise and fall of the force of eunuches in the middle and late days of the Tang Dynasty. The fact that the eunuches intervened in judicial proceedings by exceeding their power meant not only throwing into confusion the central judicial system by seizing by force the judicial power of the Imperial Court, the Circuit Court and the Board of Punishments but directly subtaging the legal system in the middle and late days of the Tang Dynasty and deepening the unstability of the political situation.
