体育运动纠纷的司法管辖——以信鸽运动为分析个案

Analysis on the Jurisdiction of the Sports Dispute——Take the racing pigeon sports as example

在目前的司法体系中,相关判例对于信鸽运动纠纷的定性和判决结果不一。本文从司法管辖的角度,分析认为,对于信鸽运动纠纷中的单纯体育纠纷,应当赋予信鸽协会有限的自治权,确立仲裁前置的纠纷解决机制;对于信鸽运动纠纷中的民事纠纷和刑事纠纷,则应当明确由法院行使司法管辖权。

Dispute settlement mechanism of the racing pigeon sports doesn’t work well.The similar racing pigeons sports disputes may get different verdicts.For pure sports disputes during racing pigeons sports,we should give limited autonomy to the racing pigeon association,put the arbitration procedure before the law suit.For civil disputes and criminal disputes during racing pigeons sport,we should hand over the problem to the court.
