摘要
我国政府十分重视对各类旅游资源的保护,制定并出台了一系列法律法规。但是,当前我国旅游资源保护立法还显得滞后,主要表现在:第一,旅游基本法缺位;第二,法出多门,效力层次低;第三,立法存在空白和漏洞;第四,立法笼统,操作性不强;第五,立法的公众参与程度不够;第六,配套制度不健全。我们应当制定旅游资源保护基本法,修订和完善旅游资源保护单项立法,明确并强化旅游资源保护法律责任制度,加强地方旅游资源保护立法,健全旅游资源保护的相关配套制度。
The Chinese government attaches great importance to the protection of tourism resources of various types, established and put forward a series of laws and regulations. However, the current legislation to protect tourism resources still lagged behind, mainly as follows: Firstly, the basic law in tourism is in vacancy; secondly, there are many laws from different sectors but the effect is in a lower level; thirdly, there are gaps and loopholes in legislation; fourthly, the legislation is general and not very effective; fifthly, the public participation in legislation is not enough; sixthly, the supporting system is not perfect. We should establish the basic law to protect tourism resources, revise and improve the individual legislation to protect tourist resources, strengthen the legal liability system and the local tourism resources protection legislation, and improve supporting systems to protect tourism resources.
