农村土地承包经营权的法律保护问题研究

Research on Legal Protection of the Rural Land Contract Management Rights

通过回顾农村土地承包经营权的法律概念及其法律保护现状,从保护农民土地权益的角度出发,针对如何完善农村土地承包经营权的法律保护制度,提出了完善土地承包经营权确权登记制度、强化土地承包经营权物权效力、完善土地流转制度及征地补偿保障制度等合理性建议,以实现对农村土地承包经营权全面的法律保护,更好地保护农民土地权益和农民土地财产权益。

By reviewing the legal concepts and the legal protection status of rural land contract management rights,from the perspective of protecting farmers’land rights,the paper takes aim how to improve the legal protection system of rural land contract management rights.It puts forward several recommendations,including improving rights confirmation and rights registration system of land contract management rights,strengthening the property effectiveness to land contractual management rights,improving land circulation system and land requisition compensation system,to achieve better protection of farmers’interests in land and achieve farmers’land property rights through the realization of full legal protection of rural land contract and management rights.
