福建农民工权益保护现状、问题与对策——基于劳动合同的视角

Situation and Problems of Protecting Migrant Workers' Rights and Interests——in the Perspective of Labor Contracts

根据在福建若干个地区收集到的问卷资料,分析劳动合同的签订与农民工权益保护之间的关系。分析结果表明,劳动合同对农民工基本工资没有正向影响,劳动合同对农民工工作时间没有负向影响,对农民工获得社会保障有正向影响。劳动合同还不能从根本上保护农民工的权益。可从加大培训力度,提升农民工的人力资本;普及法律知识,提升农民工维权意识;提高平等劳动合同的签约率等方面着手来切实提高农民工权益。

Base on the survey data collected from some areas in Fujian province, this paper tries to analyze the protecting situation of migrant workers＇ rights and interests, and to explore the relationship between signing contracts and protection of migrant workers＇ rights and interests. The result shows that signing the labor contracts has no positive effects on the migrant workers＇ basic wages, that signing the labor contracts has no negative effects on the migrant workers＇ working hours, and that signing the labor contracts has positive effects on the migrant workers＇ social security and welfare. Researches on the reasons why the labor contracts can＇ t protect the rights and interests of migrant workers on the crucial level should be made so as to improve the migrant workers＇ right and interests.
