新闻媒体、记者权利保障视阈下新闻业监管规范的现状及问题反思——兼论设立新闻道德委员会的意义

Reflection on Present Situation and Existing Problems in Journalism Regulation From the Perspective of News Media and Journalists Rights Protection:on Significance of Setting up the Ethics Committee for Journalism

通过对新闻法律、伦理规范文本及其实施效果的研究发现,这些规范性文本在对新闻媒体及记者权利保障方面存在诸多缺陷,主要存在授权性规范涉及范围有限,义务性规范操作性不强以及权利缺乏司法程序的保障三大问题。新闻道德委员会的设立是当前中国新闻监管领域的一次有益探索,对于新闻媒体、记者权利保障规范的完善乃至促进整个新闻业的发展都是一个良好的契机。

It indicates that there are many defects in protection of news media and journalists rights through the study of news law, code of ethics, and its implementation. Especially in authorization, it has flaws in existing standards from three aspects： limited ranges, less effective application and lack of protection interms of judicial process. The establishment of News ethics committee is a positive attempt in the field of current Chinese news supervision and an opportunity for the improvement of the news media and journalists rights, promoting the overall development of the journalism.
