我国当下民间法研究方兴未艾,但非法学思维模式的泛滥和与法治真命题的隔膜使其始终难以摆脱生死之问的梦魇。美国"法律重述"以其明确的示范规则、缜密的说理论证和清醒的时代自觉获得了法律界广泛认同,成为美国法治王国中一道亮丽的风景。我国民间法学者不妨效法美国"法律重述",针对法治难点和热点,将钩沉拾遗的精湛学术成果整编为翔实清晰的示范法,配以深刻严谨的评论和示例,供立法者和司法者参考采纳,促成别样民间法的生成。

The current research on Folk Law is prosperous in China.But the flood of non-legal thinking method and the alienation from true propositions on rule of law always make it a nightmare:life or death.Based on concise model rules,logical comments and unambiguous orientation,the American Restatement of Law has been widely recognized by the legal society and constitutes one charming landscape in the American kingdom of rule of law.The Chinese scholars on Folk Law may emulate American Restatement of Law,focus on the difficult and hot issues in rule of law and transform their academic achievements into comprehensive and concise model law with penetrating and precise comments and illustrations for future reference by the legislature and judiciary.Then the special Folk Law might be formulated in China.
