网络虚拟财产的法律保护现状分析

The Status Quo of Legal Protection of Network Virtual Property

21世纪,网络是大众生活不可或缺的部分,涉及网络虚拟财产的交易日趋频繁,涉及网络虚拟财产的纠纷也日益增多。但目前,我国在网络虚拟财产保护方面,立法与司法都相对滞后,经过分析可知:立法方面,网络虚拟财产的相关民事法律保护不够全面有效;司法审判方面,突出表现为用户身份确认难、用户取证难、虚拟财产价值确定难以及运营商合法利益保护难的特点。为此,有必要着重分析原有的法律保护现状,以便思考如何更好地保护网络虚拟财产。

In twenty-first century, the network is an indispensable part of publiclife. The transactions of network virtual property are increasing day by day, and the disputes of network virtual property are increasing too. However, at present, our country in the aspects of protection about network virtual property, legislation and judicature are lagging behind. The analysis shows that, in the legislation, the civil law has not provided a comprehensive and effective protection to network fictitious property, and in the cognizance of justice, it shows an outstanding performance including four important problems： confirming the identity of the users, obtaining evidence to the users, determining the value of virtual property, and protecting the legitimate interests of the operators . Therefore, it is necessary to analyze the legal protection of the original situation, so as to think about how to better protect the network virtual property.
