信息法学研究与教学中的困境及应对——主要从学科定位的角度探析

摘要 信息法学是以信息法为研究对象的法学学科。现有文献与实证调查结果显示,我国的信息法学教学研究工作在理论体系构建、研究方法采用以及教学开展等方面同时陷入了困境,而困境的根源在于该学科的定位和归属不明。立足于我国法科教育的传统并借鉴美俄等国信息法学的最新成果,将该学科定位为跨领域的独立法学门类,并据此提出应对困境的具体思路:构建独立与开放的理论体系,采用的研究方法以法学的概念分析与价值分析为主并兼采其他学科方法,在开展教学工作时注重多学科的知识结合与资源整合。 As a sub-subject of jurisprudence, the information law study focuses on the information law. However, it is illustrated by statistics and survey that the research and teaching on the intormation law study fall into dilemma in senses of theoretical system construction, methodology selection as well as lessons giving, which is aroused from paradoxical subject positioning. Based on the tradition of domestic jurisprudence education and in the light of up-to-date experience of the information law study in U. S and Russia, the author considers the information law study as an independent sub-subject of jurisprudence which refers to cross-bordering issue, and, for that matter, makes proposals for the settlement of the dilemma that independent and open theoretical system be constructed, methodology centered on notion and value analysis be established that involves methods in other fields, comprehensive expertise and resources be combined in class.
