澳门特别行政区立法会功能发挥的实践考察

A Practical Study on the Function Performance of the Legislative Assembly of Macao Special Administrative Region

澳门基本法规定,澳门特别行政区立法会是澳门特区的立法机关,承担立法和监督政府等职责。议员是立法会的核心构成,议员履行义务、行使权力的状况决定立法会功能的发挥。统计显示,澳门特别行政区立法会议员能履行出席会议、参与表决的义务,但在提出议案、质询政府、发表言论等方面则因其产生方式不同而各异,澳门特别行政区立法会议员绝大多数未积极行使立法和监督政府的职权,致使立法会呈现低活跃度形态。澳门应当在未来的改革中改变三类立法会议员的比例,增加直选议员的数量,强化立法会功能的发挥。

According to the Basic Law of Macao,the Legislative Assembly shall be the legislature of the Macao SAR and shall perform the functions of legislation and supervision of the government. The Legislative Assembly members constitute the core of the Legislative Assembly. And,therefore,the situation of how the members fulfill their obligations and exercise their powers decides the practical functioning of the Legislative Assembly. Statistics suggests that the members perform well in attending meetings and voting,but as they are elected in different ways,their performances differ considerably in putting forward motions,challenging the government,and voicing their own opinions. The Legislative Assembly of Macao Special Administrative Region presents a form of low activity as he majority of the members fail to actively excise their powers of legislation and supervision of the government. In the future reform,Macao should change the proportion of the three kinds of members,increase the number of directly elected members,and strengthen the Assembly's functional performance.
