机动车“尾号限行”的法经济学分析

摘要 从比例原则的角度,机动车"尾号限行"的合理性有一定的欠缺。尽管实施"尾号限行"可以在短时间内缓解交通拥堵状况、改善空气质量,但是该项措施在一定程度上催生了人们二次购车的欲望,引发了机动车保有量的迅速增长。长期而言,"尾号限行"的成效将会越来越弱。对私人权利以及社会成本的忽视,是该项措施饱受争议的根源。从长远发展的观点看,它应该被其他更合理合法的行政措施所取代。 The "traffic restrictions based on the last digit of license plate number" is a little irrational from the perspective of the principle of proportionality. Ahhough the implementation of the traffic restrictions could relieve traffic congestion and improve air quality in a short time, this measure will create people's desire to buy second car to some extent, and trigger the rapid growth in vehicle population. So in the long term, the effect of this restriction will be getting worse and worse. Due to the ignorance of private rights and social cost, this measure is controversial. It should be replaced by more reasonable and legitimate administrative measures in future.
