Lawyer's Political Participation in the Construction of the Order of Democracy and the Rule of Law

切实保障公民政治参与是我国近年来在推进民主化转型过程中的一项力举。律师职业群体具有独特的职业素养、角色优势与专业品质,鼓励、引导其积极参与政治生活,对于增强决策的科学性与合法性、增进社会公平与福利、消除社会戾气、连通国家与社会、型塑法治思维与法治方式并逐渐夯实我国民主进程中所必备的法治秩序具有重大意义。为充分发挥律师群体这一宝贵的政治富矿的积极功能,必须着力进行一系列机制创新,借助律协等组织资源,通过多种方式拓宽律师政治参与的渠道,激发其参与政治生活的热情,并逐步完善社会取士机制以从律师队伍中选拔人才,使德才兼备的律师能在民主法治秩序构建中贡献智识与力量。

To foster the transformation of democratization in China in recent years, a significant step is to effectively protect citizen＇ s political participation. Frankly speaking, the democratization in China will be progressively constructed instead of simple escalation. Therefore, the democracy here shall be benign and controllable. The occupation of lawyer is a group of people with unique professional qualifications, advantage of roles and specific characteristics. To encourage and help them to participate in political life will be of great importance, which will enhance the reasonableness and legality of decisions, improve social equality and welfare, eliminate social conflicts, thus to bridge the state and the society and to shape the rule of law thinking and meth- ods, for the final construction of the rule of law order. However, the situation of lawyer＇ s politi- cal participation in China is not satisfactory. To exert the functions of lawyers in the political life, it is necessary to carry out a series of innovation, such as making use of the Lawyer Association to broaden the access channels, and to absorb more talents from the occupation of lawyers in political life.
