民事自助行为的价值定位及其制度构建

民事自助行为是民法中民事权利救济体系的重要组成部分,其在弥补公力救济之不足方面效果显著。目前,大陆法系与英美法系的许多国家和地区均建立了民事自助行为制度。我国囿于传统法律思维的桎梏及相关理论研究的匮乏,尚未确立民事自助行为制度。本文以民事自助行为的正当性、科学性、妥适性、价值性四个方面为基础,通过对民事自助行为价值的再认识,准确界定其概念,进而尝试构建适合我国民法体系的自助行为制度,以期引玉之效。

At present, many countries and regions of continental law system and Anglo - American law system have established civil self - help behavior system. Owing to the shackles of traditional law thinking in China and the lack of relevant theoretical research, civil self - help behavior system has not been established in our country. From the legitimacy, scientific and appropriate eligibility of civil self- help be- havior, through the re - recognition of the value of civil self - help behavior, this article tries to define its concepts and construct the system of self - help behavior in our civil law system, so as to lead the jade effect.
