摘要
基础性专利是一个新概念,有很多基本问题需要学术界做出回答。利用几个经典案例归纳和回答了基础性专利"是什么","从哪儿来","到哪儿去"等基本问题,认为它是来源于基础研究,形成于技术科学研究的基础性发明的专利化存在形式。最后鉴于基础性专利所蕴含的丰富的政策含义,提出了面向基础性专利培育的政策设计构想,以基础性专利的形成带动各项资源要素的配合,提升我国的自主创新能力。
There are many fundamental issues about the ＇basic patent＇ that need academia to answer. Therefore we take advantage of several classic cases to conclude and answer some questions like ＇what＇, ＇where they came from＇, ＇where to go＇ and so on. It is consider that basic patent is derived from basic research, and produced from the patented form of the basic invention which is the results of technical science research. In view of the abun-dant policy implications the basic patent contained, the policy design facing to basic patent fostering is concluded in order to enhance our capabilities of independent innovation with the cooperation of various resource factors.
