摘要
新《劳动合同法》对劳务派遣员工合法权益的维护和保障起着重要的意义,通过对新法中劳务派遣制度进行解读发现,新劳务派遣制度在派遣机构准入门槛、派遣员工与正式员工同工同酬、派遣数量和岗位等方面还存在一些"可操作性"漏洞,并指出了新法实施过程中可能面对的新情况。不断细化和完善劳务派遣相关制度,并在法律执行过程中建立保障机制,保证执法效果,是实现新法目标、保障派遣员工的合法权益、使派遣员工切实享受改革成果的重要途径。
The new"Labor Contract Law"has important significance to protect the legitimate rights of the dispatching employee.After studying the interpretation of dispatching system of the new labor law we found that there are some"operational"loophole in new dispatching system such as sending agencies access threshold,providing the equal pay for equal work between dispatching employee and regular employees,and the number and positions of labor dispatching.The new problem in the process of implementing the dispatching system is pointed out.It is the important way to achieve the goal of labor law,protect the legitimate rights of the dispatching employee,ensure dispatching employee enjoying the fruits of reform by constantly refining and improving the labor dispatch system,establishing guarantee mechanism in the process of law enforcement and ensuring the effect of law enforcement.
