河北省集体建设用地使用权流转管理制度完善对策

Management System Perfection of Collective Construction Land Use Right Transfer in Hebei Province

河北省正面临着新一轮大发展、大跨越的历史机遇,经济发展所需土地指标缺口很大,完善集体建设用地流转管理制度以释放农村集体建设用地潜力成为破解其"土地难"问题的重要途径。研究显示:河北省集体建设用地使用权流转存在隐形流转、收益分配混乱等诸多问题;河北省现行流转管理办法与国家层面政策导向存在不符之处,与比较规范的地方流转管理制度相比存在一定的差距,可操作性不够强。在此基础上,从借鉴各地经验、完善河北省流转管理制度具体建议和建立健全相关配套管理政策等方面提出了河北省集体建设用地使用权流转管理制度完善的对策建议。

Hebei Province is facing a new and historic opportunity of great development , but land needed for economic development is insufficient . Perfecting the management system of collective construction land use transfer to release the potential of rural collective construction land is an important way of resolving the issue of land insufficiency .The research reveals that phenomena of invisible transfer and disordered income distribution exist in collective construction land use right transfer in this province ,and that there are some discrepancies between national level policy guidance and current transfer management measures of Hebei Province ,whose operability is not good enough .Referring to the experience of other provinces , this paper puts forward such proposals as improving transfer management system and establishing a sound supporting management policy for the purpose of perfecting the management system of collective construction land use right transfer .
