行政公布食品安全消费警示制度的检视与反思

Refl ection on Government's Warning of Food Safety

一方面,行政公布食品安全消费警示业已成为规制食品安全的重要手段,为社会群体自我防范风险提供保障;另一方面,由于执法不当,这种规制手段又可能侵害到具体第三方的合法权益。透过"典型事件"寻找消费警示在食品安全法规范中的定位,分析现有法律制度存在的不足之处和实践中存在的问题,同时主张将消费警示法律关系类型化,并通过借鉴国外的立法和司法实践,提出公布食品安全消费警示法律控制的一点思考。

One the one hand, the food consumption warning issued by the government has become an important means of regulating food safety, and providing guarantee to social groups to address risks. One the other hand, owing to improper law enforcement, it may infringe upon a third party's legal rights.This paper samples some typical cases to discuss role of food consumption waring in implementing the food safety laws. Then, the paper analyzes the defi ciencies existing in the current law system and some practical problems. After that, the paper discusses experiences of other countries in legislation and judicature, and proposes measures to effectively publish food consumption warning. Finally, the paper suggests that the legal nexus of food consumption warning should be categorized.
