判定微博内容是否是作品,是否受我国著作权法保护,关键是看其是否具有独创性,因此,对独创性的认定对于解决这类问题至关重要。本文通过对独创性原理的分析,对微博内容独创性的判断给出建议。

To determine whether the content of micro-blog is works or not, whether it is under the protection of Chinas copyright law, the key is to see whether it has the originality, there- fore, the affirmation of originality is crucial to solve this kind of problem.
