大学生实习期间人身伤害事故责任划分的分析——以高职院校为例

The division of responsibility for personal injury accidents during college students′ internship

高职教育适应就业、培养实践技能的教学特色必须施以企业一线教学实习,而这期间大学生的人身伤害事故频发,因实习生的法律身份定位缺失,各方难免互相推诿。必须通过重构高职院校大学生实习期间人身伤害事故的归责原则和举证责任,重新划分各方当事人的责任,尤其是社会化过滤各方责任,从而实现对各方的保护。

With the rapid development of higher vocational education in China, practical skill-oriented and employment-targeted teaching practice must be applied in enterprises. But college students′ personal injury accidents occur frequently during this period, and meanwhile the parties concerned may shift responsibility due to the lack of legal identity of the interns. The division of responsibility and burden of proof for personal injury accidents during college students′internship must be reconstructed and the liability of all parties must be divided, so as to realize the protection of the parties.
